Terms of Service
These terms are an agreement between you and Marc Chametzky, the developer and operator of OttoMiles, publishing under the Mementoria name (“we,” “us”). By installing or using OttoMiles you accept them. If you don’t, please don’t use the app.
1. The app license
Your license to use the OttoMiles app on your iPhone is Apple’s Licensed Application End User License Agreement. These terms sit on top of it and cover the OttoMiles service: your account, the Pro subscription, and the data you sync. If the two ever conflict about the app license itself, Apple’s agreement controls.
2. Who can use OttoMiles
You must be at least 18 and located in the United States. OttoMiles is built for people who drive for delivery and rideshare platforms; you are responsible for complying with those platforms’ own terms while you use it.
3. Free tier and OttoMiles Pro
The free tier measures your miles and lets you log blocks, earnings, and expenses, entirely on your device. OttoMiles Pro adds sync across devices and route insights, and is sold as an auto-renewing subscription through Apple’s App Store.
- The price and billing period are shown in the App Store when you subscribe. Payment is charged to your Apple account at confirmation.
- Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
- You manage or cancel it in your iPhone’s Settings under your Apple Account, then Subscriptions. Cancelling keeps Pro active until the end of the period you already paid for.
- Refunds are handled by Apple under its policies; we can’t issue them ourselves. Apple’s support page is reportaproblem.apple.com.
- If we offer a free trial, it converts to a paid subscription at the end unless cancelled before then.
4. When Pro lapses
If your subscription ends, the app keeps working on the free tier and everything already on your device stays there. Sync stops. We keep your cloud copy so that re-subscribing picks up where you left off; you can ask us to delete it at any time, as described in the Privacy Policy.
5. Your data and your records
You own the data you put into OttoMiles. You give us permission to store and process it only as needed to run the service for you, and to include your Pro stop analysis in the aggregate station statistics that subscribers see, both as described in the Privacy Policy.
OttoMiles measures mileage from your phone’s sensors and applies reference figures such as the IRS standard mileage rate. These are estimates and can be wrong: GPS drifts, phones sleep, and rates change. You are responsible for reviewing your records and for anything you file or report based on them. OttoMiles is not tax, legal, or financial advice. Talk to a professional about your own situation.
6. Your account
Keep your sign-in credentials to yourself and tell us if you think someone else has used your account. One account per person. You can delete your account at any time by emailing [email protected].
7. Acceptable use
Please don’t:
- use OttoMiles to break the law or anyone else’s rights;
- probe, overload, or interfere with our servers, or access them other than through the app;
- use the feedback tool to send abusive, unlawful, or other people’s private content;
- resell or share access to a Pro account.
8. Ending things
You can stop using OttoMiles whenever you like. We may suspend or close an account that breaks these terms or that we reasonably believe is being used to harm the service or other users. If we do, we will tell you why unless the law prevents it. Sections 5, 9, 10, and 11 survive.
9. No warranty
OttoMiles is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and accuracy. We don’t promise the app will be uninterrupted, error-free, or that every mile will be captured.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or tax outcomes, arising from your use of OttoMiles. Our total liability for any claim is limited to the amount you paid us for Pro in the twelve months before the claim, or $50 if you paid nothing. Some states don’t allow these limits, so they may not fully apply to you.
11. Governing law and disputes
These terms are governed by the laws of North Carolina, without regard to its conflict of laws rules. If we have a dispute, email us first and we will try to sort it out. Anything that can’t be resolved that way goes to the state or federal courts located in Wake County, North Carolina, and you consent to their jurisdiction.
12. Changes to these terms
We may update these terms. If a change matters, we will update the date above and notify account holders in the app or by email before it takes effect. Continuing to use OttoMiles after that means you accept the change.
